Mango Stationers, Thane....are cheaters
Dear friends,
Hi,
I sincerely believe that the onus changing the society is with the individuals like you and me. We cannot take things lying down and also blame the situation, and the country at large. I hate people who say “This is India, this is the only way it works here” It is the common man who will have to raise a voice against every unjust act.
A Transcend Make, (T.sonic 610 pearl white coloured, 1 GB MP3 player with serial no. 139477 1545 0623 with 1year warranty, Cash Memo No. C2 / 4599 / 06-07) was purchased from M/s. Mango stationers, 4/5, Pradhan Building, Gokhale Road, Naupada, Thane (W) 400602. Maharashtra, India, on 30th June 2006.
On 16th March, 2007 the device developed some snag in the course of normal use. It stopped entire functioning, and was not getting detected, when connected to the computer. All known methods such as reset and format did not help. As the device was under warranty, I decided not to temper with it in any way and approached M/s. Mango stationers.
The boy at the counter thoroughly inspected the device for temper / physical damage etc. when satisfied; he told me that it will take at least a week or so for repair. He gave me a rough delivery challan which did not mention any thing properly. I protested, but all in vain, as couple of others had accepted the same rough note just in front of me, and the Owner at the counter told me that this is the only way they operate. Reluctantly, I agreed to the rough note.
After about three visits to the shop & six phone calls finally on 16th March 2007 (Exactly three months latter) I received a call from M/s. Mango that the said MP3 player has been repaired. So I went to the shop for collecting the same. I thoroughly checked the player & its performance & was satisfied with it. But, I was surprised to learn from the owner that the MP3 player has been repaired at cost of Rs. 650 (Six Hundred & Fifty) by the manufacturer M/s. Transcend, and so I will have to bear the cost of the repair. I argued that there is no question of repair cost as the player was in warranty. We had an argument about the same. I was confident of my stand and there was no question of me bearing the cost.
Ultimately, I agreed to his stand that, he is only a retailer and that the manufacturer had charged for the repair. So, I agreed to pay him Rs. 650, but with a condition that he will give me a pucca (correct) invoice / bill for Rs. 650. Again he frowned. He said he cannot issue a correct bill. I also gave him another option of giving me a copy of what Transcend had charged him. He was not ready for this either. Finally I declared that under this condition I cannot take the product, and that I will be going to the consumer court.
I went to the consumer court in Thane. There the officer informed that there are already a dozen cases pending against M/s. Mango Stationers. He suggested me that I should first take the product in my custody. Also my case was weak as I had not taken a correct receipt while handing over the MP3 player for repair. Nevertheless, he suggested me to file a case next day as it was already 5:30 PM.
I came back to M/s. Mango Stationers, paid him Rs. 650, took a rough receipt of the payment and took the MP3 player. The MP3 player seemed ok on the face of it. I left the shop. Latter I noticed that the player had been physically damaged. Now I could easily understand that it had been damaged intentionally by the shop owner. Now he could always say that the product when brought for repair was damaged beyond warranty and so he had accordingly charged for the repair. I have been cheated. I am the 13 person to be cheated who is going to the consumer court. (from where I have no hope)
